Before using the PLAUD websites and services ("Platform") operated by PLAUD Inc. ("we" or "our"), please read these terms and conditions ("Terms", "Terms and Conditions") carefully. Your access to and use of the Platform are conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, customers and others who wish to access or use the Platform, purchase products, or use our services. By accessing or using the Platform, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Platform or purchase our products/services.

Pricing and Order Terms

1. Product Prices and Availability

4. Subscription Terms and Cancellation

Subscription services are billed on a monthly/annual basis. Subscriptions automatically renew at the end of each billing period unless canceled prior to renewal.
Cancellation can be done via your account settings or by contacting support@plaud.ai. Payments are charged at the start of each billing cycle. Refunds for partial subscription periods are not provided unless required by law.

Order Cancellation and Returns

1. Order Cancellation

Before Shipment: Cancel orders by contacting support@plaud.ai prior to shipment confirmation.
After Shipment: Order cancellation is not available once you receive the shipment notification confirming dispatch. You may still initiate a return after delivery under our return policy.

2. Returns and Refund Policy Overview

30-Day Free-Reason Returns: If you are unsatisfied with your purchase for any reason, you may return it within 30 days of delivery for a full refund. Returned items must be in good condition and include all original packaging and accessories.
7-Day DOA (Dead on Arrival): If you receive a damaged, incorrect, or non-functional product, you may request a replacement or full refund within 7 days of delivery by submitting supporting documentation.
Accessories: Unused accessories are eligible for return within 30 days of delivery.
Digital Products: Annual Memberships or Transcription Quotas that have not been activated or used are eligible for a full refund within 30 days of purchase.

3. Refund Processing

Refunds are typically processed within 5–10 business days of receiving and approving returns.

4. Additional Terms for EU Consumers

If you are a consumer residing in the European Union, you are entitled under EU consumer protection law to withdraw from your purchase contract within 14 days of receiving the goods, without giving any reason.
To exercise this right, simply email us at support@plaud.ai with a clear statement of your decision to withdraw. Upon valid withdrawal:

  • We will refund all payments received from you, including the cost of standard delivery (if applicable), within 14 days of being informed of your decision.
  • We may withhold the refund until we receive the returned goods or evidence that they have been sent back.

    • This statutory right of withdrawal operates independently of our 30-day return policy and does not affect your additional rights under our standard return terms.

    Accounts

    When you create an account with us, you guarantee that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Platform. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

    Minors under the age of 16 (EU)/13 (US) must obtain parental or guardian consent before using the Platform. If you are a parent or guardian and believe a minor has used our services without consent, please contact us at support@plaud.ai.

    Marketing Communications

    By providing your email address, you consent to receive promotional emails from us, including product updates, promotions, and events.     Termination

    We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion. However, we will exercise this power reasonably and in good faith, for any justifiable reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

    Limitation Of Liability

    To the maximum extent permitted by law, PLAUD Inc., including its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages such as loss of profits, data, goodwill, or other intangible losses arising out of or in connection with your access to or use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory.
    Nothing in this section shall exclude or limit our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability which cannot be excluded or limited under applicable law (including, where applicable, EU consumer law). For consumers residing in the European Union, statutory rights under applicable consumer protection laws, including a two-year legal warranty for goods, remain unaffected by these Terms, and nothing herein shall affect your statutory rights under applicable consumer protection laws.

    Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. PLAUD Inc., its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, securely, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components, or d) the results of using the Service will meet your requirements.

    Governing Law

    These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. However, if you are a consumer, you may be entitled to the protection of the mandatory consumer protection laws and regulations of your country of residence. Nothing in these Terms shall affect your rights under such mandatory local laws. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between you and PLAUD Inc. regarding your use of our Platform and supersede any prior agreements.

    Changes

    We reserve the right to modify or replace these Terms from time to time. Where changes are material, we will provide at least 30 days' prior written notice by email or through our Platform. For non-material changes, we will notify you through the Platform at least 15 days in advance. If you do not agree to the updated Terms, you may terminate your use of the Service at any time. Continued use of the Service after the effective date of the changes constitutes your acceptance of the revised Terms.
